This agreement between Congdon’s Doughnuts, Inc. (“Congdon’s”) and the vendors that operate at Congdon’s After Dark food truck park explains what is allowed, permitted, and expected of each vendor.
LICENSING/INSURANCE
All vendors must be licensed by the State of Maine and the Town of Wells prior to service.
Congdon’s shall be named as indemnify with each vendor’s insurance policy. Vendors must provide a copy of the insurance policy prior to service. All vendors must have valid vehicle and worker insurance and have written acknowledgement of said insurance.
SAFETY
Food safety is a primary concern. Each vendor is responsible for acquiring and maintaining all applicable licenses and permits for a food service operation. Further, each vendor will have a qualified ServSafe certified person on board at all times to ensure the safety of the products being served. Non-compliance with town, state, federal, and ServSafe regulations is grounds for expulsion from the park. Protective gloves and hair restraints must be used.
Congdon’s complies with recommendations from the federal and state Center for Disease Control & Prevention. All vendors must follow safety rules in accordance with these recommendations and any additional precautions required by Congdon’s management, including masking rules.
Each vendor is responsible for the safety and upkeep of their individual truck/trailer/cart. All cords, fuel, and accessories will be maintained by a qualified technician. All refrigeration will be maintained and in good working order and include thermometers, as per state health code requirements. Each vendor must have a fire extinguisher on board at all times.
Participating vendors may not use excessive signage (one A frame is acceptable), tables, sheds, coolers, or obstructions outside of the perimeter of the vehicle/cart without approval from Congdon’s management. Electrical cords must be arranged in a manner as to not obstruct patrons or create hazards. Excessive lighting is prohibited.
Vendors must not amplify music. Items that could create a potential fire hazard are prohibited.
SERVICES PROVIDED
Congdon’s will make available: daily trash removal, restrooms, electrical service, mosquito/tick control, parking, seating, wireless internet (please note we are limited by Spectrum’s abilities to provide and recommend all trucks have a hot spot), ATM, security, ancillary marketing, and indoor seating.
Electrical service depends wholly on the viability of the power grid and ability of the vendor to utilize our GFCI-protected system. In the event of an outage, Congdon’s is not responsible for any equipment failures, food spoilage, or losses. Electrical surges have the potential to occur in individual trucks depending on the load configuration on the panel. Congdon’s is not responsible for any truck equipment issues should this occur.
Trucks are permitted to stay connected to part electricity overnight. We strongly encourage trucks to store food in their own facilities overnight and utilize a power alert device in the event power is lost overnight. Congdon’s is not liable for any food spoilage that occurs as a result of lost power.
While wireless internet will be provided, access is not guaranteed. We recommend having a hot spot or cellular access for credit card processing.
Amenities at our food truck park DO NOT include the following:
• Cardboard disposal
• Wastewater/greywater disposal
• Waste oil disposal
• Use of coolers, storage, or dishwashing capabilities
• Ice
• Food preparation space
• Broken bills/change/currency exchange
• Individual water pressure hook-ups
• Staff overnight parking
All vendors are responsible for putting their trash in the dumpsters. Vendors must not place trash into the guest trash cans in the park.
FEES/CANCELLATIONS
Vendors will be charged according to the stated fee schedule. All vendors must keep their credit card on file with Congdon’s, which will be charged on the Monday following service or shortly thereafter. All vendors are required to communicate with Congdon’s 24 hours prior to service via email to info@congdonsafterdark.com if they intend to not be at the park on a night in which they were originally scheduled. Failure to provide 24 hours’ notice will result in the vendor being charged the standard fee for that day. Congdon’s reserves the right to use the vacated spot during the absent day.
Our intent is to remain open in most weather conditions. The decision to close the park is solely the discretion of Congdon’s management.
Vendors may cancel a scheduled service at any time without penalty for valid weather-related reasons, as determined by Congdon’s management. However, any vendor that begins service when the park opens at 4 pm will be charged the standard fee, regardless of when the park closes due to weather. Vendors may be able to remain open during certain weather events at the discretion of Congdon’s management (half fee if the park is otherwise closed).
At times, we offer a 10% discount to certain groups (such as car owners in the antique automobiles night and non-profits, etc.). All vendors in service on that evening are required to participate in this program.
Congdon’s reserves the right to waive or reduce fees as it deems fit.
PARK/SERVICE REQUIREMENTS
Vendors must have their vehicle on site 30 minutes prior to service unless otherwise cleared by Congdon’s management. Repeated violations will result in revocation of future invitations.
Park hours may vary, but vendors must be prepared to serve until at least 9 p.m. and may not leave sooner than 8 p.m. Sun to Thur and 9 p.m. on Fri and Sat. Scheduling preference may be given to those who stay later.
Due to the configuration of the park, it may not be possible for vendors to exit the park at the desired time. We encourage trucks to stay until at least 9 pm, therefore we ask that vendors do not attempt to pressure other vendors to close or maneuver their vehicle during service. Vendors may address specific issues with Congdon’s management.
Owners and their employees MAY NOT park in guest parking unless previously approved by Congdon’s management. All staff must park in the supplemental grass parking area (next to the large gravel lot) or on Congdon’s employee parking area at 1064 Post Road (between Nautical Mile and Barefoot Cottages).
Food trucks/carts may only be left overnight when they are scheduled to serve at the park the next day, but may need to move to accommodate the Congdon’s drive-thru. Congdon’s is not responsible for any vehicle left on site or its contents. Trucks and trailers must be locked and secured every night.
Congdon’s cannot be designated as a drop-off site for deliveries. Each vendor is responsible for their own inventory and storage.
Congdon’s has exclusive rights to sell alcoholic beverages and cannabis-based products.
Vendors must request permission to employ any person currently employed by Congdon’s Restaurant or Congdon’s After Dark.
While Congdon’s will attempt to limit cuisine overlap on most evenings, no vendor is given exclusive rights to any specific cuisine or food items. Congdon’s reserves the right to exclude specific menu items that conflict with its efforts to minimize overlap. Congdon’s also reserves the right to remove menu items it deems to be a potential health hazard.
In accordance with the plans approved by the Town of Wells, vendors may not be open to the public while Congdon’s restaurant is open to customers. All vendors will abide by all Town of Wells ordinances.
CONDUCT
All vendors and their employees will conduct themselves in a way that is considered by Congdon’s management to be family-friendly and consistent with Congdon’s mission statement: “Delight the guest in a way that creates loyalty every time, everyday.” Any vendor deemed in violation of this will be closed for the evening and potentially expelled from the park.
No vendor will offer anything for sale that could be considered illegal, immoral, lewd, sexual, or not family-friendly, as determined by Congdon’s management.
Vendors cannot discriminate based on race, religion, age, gender, sexual orientation, military service, political affiliations, etc.
All participating vendors are hereby notified that video cameras are recording activity of the park.
Vendors may not enter the back offices/kitchen/bakery of the building unless given permission by Congdon’s management.
PARTICIPATION
Participation is on an invitation-only basis. There are no rights for continued participation and vendors may be asked to leave the park for any reason at any time. Congdon’s may revoke invitations for future scheduled days for any reason at any time.
Congdon’s reserves the right to board/examine the truck/cart at any time to ensure compliance with the rules stated within during their time at the park.
Vendors deemed in violation of this agreement will be charged in accordance with the stated fee schedule regardless of length of service on the day of the violation.
